2. For the purpose of ascertaining the necessity of enforcing Bond necessity to be restrained, the Immigration Agents upon representation made to either of them, in their respective portions of Canada, shall ascertain and claim the right of indemnity for the maintenance and support of any such specially reported Passenger and shall report the same to the Governor through the Minister of Agriculture, and the said report shall be final and conclusive in the matter and shall be evidence of the facts therein stated.
3. And the said penalty shall be sued for, or so much thereof as from time to time be sufficient to defray the expense of the maintenance and support of any passenger for whom the said Bond shall be prosecuted for and recovered by suit or action in Her Majesty's realm or in any Court in Canada having jurisdiction in cases to the amount.
